Safety Rules for Terminal 1

The purpose of this document is to inform each participant of the safety and preventive measures applicable to the activities offered in Terminal 1, and to document their acceptance of the associated risks.

Each activity within Terminal 1 is operated by the operator responsible for that activity:

1. Voluntary Participation and Prior Information

Participants acknowledge that participation is free and voluntary. Before taking part in an activity, participants must:

• Verify that they meet the applicable participation requirements for the activity in question, as set forth in Sections 2 and 4 below. 
• Familiarize themselves in advance with the nature, operation, restrictions, and risks inherent in the activity;
• Determine, on their own responsibility, whether they are physically and mentally fit and sufficiently comfortable to participate;
• Refrain from participating or stop participating at any time if they have any doubts, feel uncomfortable, or no longer wish to continue;
• Comply at all times with the safety rules, safety regulations, and instructions provided by staff.

By participating in an activity, the participant agrees to attend the safety briefing and to ask staff any questions they may have before the activity begins

2. Fitness, Health, and Restrictions

By participating in an activity, the participant confirms that they are physically and mentally fit to take part and that they do not have any medical conditions that could prevent them from doing so (including epilepsy, photosensitivity, severe claustrophobia, heart conditions, respiratory disorders, sensitive eardrums, and similar conditions). They also confirm that they are not under the influence of alcohol, drugs, or medication that may affect their alertness, reflexes, or behavior.

 Certain activities may be subject to requirements regarding age, height, supervision, attire, physical fitness, punctuality, etc., or the relevant operator may require participants to sign a specific liability waiver. Proof of age may be requested upon arrival. Failure to comply with these requirements, including those set forth in Section 4 below, may result in denial of access or exclusion from the activity without a refund or compensation.

3. Acceptance of Risks Inherent in the Activities

The participant understands that the activities offered in Terminal 1 involve inherent risks that exist independently of any fault on the part of the relevant operator.

These risks include, but are not limited to, collisions or contact with other people, karts, equipment, or scenery; slips, falls, impacts, entrapments, cuts, sprains, strains, fractures, or injuries resulting from improper use of equipment; fatigue, muscle or joint pain, neck or back problems; nausea, dizziness, disorientation, motion sickness, or discomfort associated with virtual reality, screens, movement, speed, force feedback, stress, time pressure, darkness, confined spaces, sudden sounds, or lighting effects; as well as physical consequences resulting from sustained physical exertion.

By participating in the activity, the participant acknowledges that their participation is free and voluntary, and that they could have chosen not to participate. They also acknowledge that they accept the risks involved, including those arising from the actions of other participants.

4. Terms of Access

Participation in the activities is prohibited for individuals who do not meet the minimum safety requirements or for whom the activity may pose a risk. This includes, but is not limited to, the following:

• persons who do not meet the required age and/or height requirements;
• pregnant women;
• people with a medical contraindication or who suffer from epilepsy, photosensitivity, severe claustrophobia, heart or respiratory conditions, pain in the neck, back, or legs, balance disorders, recurrent nausea, hearing sensitivity, an increased risk of fractures, unexplained loss of consciousness within the past five years, or people with a pacemaker;
• people who have difficulty understanding or following instructions, whose reflexes are impaired, who suffer from serious concentration problems, or who experience anxiety-related reactions;
• for activities involving a vehicle-driving experience (including Supercube), adults who are medically unfit to hold a driver's license, and minors who are medically unable to ride a bicycle.

Access to activities may also be subject to additional conditions imposed by the relevant operator, particularly regarding punctuality or the signing of a liability waiver. If in doubt, participants should refrain from taking part.

5. Safety Instructions and Conduct

The participant agrees to strictly comply with all posted rules, safety briefings, and staff instructions. In particular, they agree to behave carefully, respectfully, and safely; not to run, push, or intentionally make physical contact; not to leave authorized areas; not to damage, force, move, or misuse equipment, vehicles, scenery, mechanisms, or safety devices; to wear any required equipment or clothing (including closed-toe shoes and tied-back hair, and ensuring that clothing and scarves are secure); not to bring weapons, illegal substances, or prohibited items onto the premises; not to make unauthorized recordings; report any incident, illness, malfunction, or dangerous situation immediately; and discontinue the activity if they no longer feel fit to participate.

In the event of an emergency or medical incident, the participant (or their legal representative) authorizes staff to contact emergency services. The participant shall be responsible for any medical expenses incurred, unless otherwise required by applicable law.

Any person who fails to comply with the rules; behaves in a dangerous, abusive, threatening, disruptive, aggressive, intoxicated, unsportsmanlike, or antisocial manner; or compromises the safety or proper conduct of the activity may be denied access or excluded from the activity immediately, without refund or compensation.

No refund will be issued in the event of failure to comply with access or safety requirements, absence, tardiness, or voluntary withdrawal from the activity.

The participant shall remain personally liable for any damage caused as a result of their fault, negligence, recklessness, or failure to comply with instructions and applicable rules.

Animals are not permitted on the premises or in the activity areas, except for service dogs accompanying a person with a disability.

6. Liability

Each activity is operated under the responsibility of the operator in charge of that activity.

This document does not limit or exclude the operator’s liability in cases of fraud, gross negligence, or bodily injury caused by the operator, its employees, or agents.

For all other matters, and to the fullest extent permitted under Belgian law, the operator’s liability shall be limited to direct and foreseeable damages, not exceeding the amount paid by the participant for the relevant activity.

The relevant operator shall not be liable for any damage resulting from the participant’s failure to comply with the rules, restrictions, or safety instructions; from any inaccurate or incomplete declaration; from the conduct of a third party or another participant; from the risks inherent in the activities and accepted by the participant; or from the loss, theft, or damage of personal belongings, except where such damage results from a fault attributable to the operator.

Nothing in this document shall affect the mandatory consumer rights granted under Belgian law.

7. Minors

If the participant is a minor, this document must be signed by their legal guardian. 

By signing this document, the legal representative declares that he or she has the necessary legal authority to consent to the minor’s participation. He or she confirms that he or she has read and understood the nature of the activity, the risks involved, and all the conditions set forth in this document.

They agree to ensure that the minor follows all safety instructions, rules, and directions given by staff.

8. CCTV Surveillance and Image Rights

Certain areas of Terminal 1 and certain activities may be subject to CCTV surveillance for the purpose of ensuring the safety of individuals, protecting property, preventing incidents, and identifying potential violations.

The presence of CCTV surveillance is indicated by the legally required signage. Any processing of images shall be carried out in accordance with applicable Belgian law and the General Data Protection Regulation (GDPR). Participants enjoy the rights granted by such laws, subject to the conditions and limitations set forth therein.

Entering an area marked to indicate the presence of CCTV surveillance cameras constitutes prior notice of their existence.

The areas in question and the respective data controllers are as follows:

•  Fire-Starter SA (BCE 0411.679.579) is responsible for the CCTV cameras in the common areas of Terminal 1, the EVA virtual reality arena, The Sim Power area, and the Supercube area.
• Netlux Entertainment SRL (BCE 1033.672.679) is responsible for the cameras in the Time Mission area.

CCTV surveillance implemented for security purposes is based on the legitimate interests of the relevant operator(s), in accordance with Article 6(1)(f) of Regulation (EU) 2016/679 on the protection of personal data (General Data Protection Regulation—GDPR).

In accordance with the Privacy Policy of Fire-Starter or Netlux Entertainment, and for the cameras under their respective responsibility, the recorded footage is retained for a maximum of one month, unless its retention is necessary in connection with ongoing legal or disciplinary proceedings.

Access to recorded footage is strictly limited to the data controller and those persons acting under its authority.

Any individual whose image is recorded has the right to access footage relating to them, as well as the rights granted under the GDPR, including the right to rectification, erasure, and restriction of processing. These rights may be exercised by contacting the relevant data controller.

9. Acceptance

By participating in one or more activities offered in Terminal 1, the participant declares that they have read this document in its entirety, understood its contents, and accepted all of its provisions without reservation.

The participant expressly acknowledges that they have had sufficient opportunity to ask questions regarding the activity, its risks, the conditions of participation, and the contents of this document before taking part, and that all necessary explanations have been provided.
