AARTICLE 1: APPLICATION OF THE TERMS AND CONDITIONS


1.1. These General Terms and Conditions of Sale (hereinafter “ Terms ”) exclusively govern the relationship between Brussels Expo, a non-profit association with its registered office at Place de Belgique 1, in 1020 Brussels, Belgium, and registered under company number BE 0406.655.573, Brussels Trade Register, acting in connection with certain events under the trade name “ Ticketlive ”, (hereinafter “ Brussels Expo ”) and any person holding or having purchased a ticket to an event via theplatform ticketing ticketing managed by Brussels Expo (hereinafter “ Buyer ”). These terms and conditions also apply to orders for purchaseaccessaccess for an event (hereinafter “ Ticket(s) ”) purchasedes by other meanss(for example, via the phone or self-service kiosks).

Under the Terms, depending on the event, Brussels Expo acts :

or as an organizer and service provider for the sale of Ttickets for its own events ;
or as a service provider for the sale of Ttickets for events organized by other organizers (at Brussels Expo or elsewhere) from whom Brussels Expo obtains the tickets and, any anygoods and/or related services to be sold to the Buyer.

The term “ Organizer " in the Terms and Conditions refers to the person (individual or legal entity) who organizes thethe event.

1.2. These Terms and Conditions are an integral part of the contract concluded between Brussels Expo and the Buyer and apply to the exclusion of all other terms and conditions or deviating clauses, including, but not limited to, any prior written communication or negotiation, as well as any general or specific of the Buyer, even if such terms provide that they are the only that apply. Any specific, written, and deviating terms and conditions shall only be accepted with the express written consent of Brussels Expo (i.e., expressly referring to these Terms and Conditions).

1.3. Brussels Expo reserves the right to modify or update the Terms at any time. The Terms applicable to Ttickets of the Buyer are those in effect on the date of the order of Ttickets by the Buyer. The new Terms and Conditions will apply to any future orders placed by the Buyer after the Terms and Conditions are posted online of the new Terms on the ticketing platform managed by Brussels Expo (hereinafter: “ Ticketing platform ").


ARTICLE 2: NO RIGHT OF WITHDRAWAL


In accordance with Article VI.53,12 of the Economic Code, the Buyer may not exercise the right of withdrawal provided for in Article VI.47 for the provision of services related to leisure activities if the contract providesa a specific date or period of performance.

The Buyer acknowledges that they have been informed and agrees that they do not have the right of withdrawal.


ARTICLE 3: TICKET ORDERING PROCESS


3.1 TERMS OF PURCHASE

3.1.1. Depending on the event, tickets may be purchased online via the ticketing platform or, when specified by Brussels Expo or the Organizer, via self-service kiosks or by phone or via any other means of sale(collectively, “ Sales channels ").

The Tickets, sold via the ticketing platform, can only be obtained by filling out the online form available at this Pplatform.

3.1.2.The purchase of Tickets is reservedfor legal entities and individuals who have the legal capacity to enter into a contract or, where applicable, who have received the necessary authorization from their parents or guardian (or any person exercising parental authority). Brussels Expo reserves the right to verify the age or authorization at any time and, if necessary, to refuse the order.

3.1.3.Without prejudice to the foregoing,Tickets are available subject to the terms and conditions and in the quantities specified by the Organizer.

For certain events, the Ttickets may be available with other options (for example, a VIP package), or (transportation, Food & Drink vouchers, etc.) andand/or products (promotional materials, etc.) additional.

The purchase of Ttickets can also be subject to certain conditions(such as, but not limited to: a maximum tickets per buyeror per household, payment by credit card or debit cardit (only), anevent requiring a minimum age specific for admission, etc.). Brussels Expo reserves the right to cancel any Tickets ordered that do not meet these conditions. Some seats may also be sold with restrictions, such as a limited view of the stage.

Other conditions, imposed by health or safety measures, may apply during the event.  

3.1.4.Without prejudice to the other grounds for cancellation provided for inthe Terms and Conditions, Brussels Expo and/or the Organizerreserve the rightto reject or cancel any order placed by the Purchaser in the following cases:

i. There is a dispute between Brussels Expo and/or the Organizer, on the one hand, and theBuyer, on the other hand, regarding a previous order;
ii. theThe Buyer has breached one or moreprovisions ofthe Terms and Conditions;
iii. theThe Buyer has been involved in or is suspected of illegal or fraudulent activities.

BrBrussels Expo reserves the right to request proof of the Buyer’s identity at any time.

3.1.5.Discounts and promotional offers cannot be combined.The Buyermay be asked to provide proof of the discount or promotional offerat the time of ordering.  

3.2. PRICE

3.2.1.The prices of Tickets, booking fees, transaction fees, shipping costs, and/or the mobility fee are listed in euros and include all taxes and VAT, unless otherwise specified. Taxes and VAT are the responsibility of the Buyer.

3.2.2.Additional and optional services and/or goods (“OptionalGoods”) may also be offered to the Buyer (for example, parking, food and beverage vouchers, promotional materials, insurance, or transportation) and ordered by the Buyer through one of the available sales channels.

3.2.3. In the event of an erroneous or incorrect price being displayed on the Pticketing platformfor any reason (technical, human, IT, or other), the order, even if it has been confirmed by Brussels Expo, will be canceled. The Buyer will be notified as soon as possible and may, if they wish and if Tickets are still available, place a new order at the corrected price.  

3.3. ORDER AND PAYMENT

3.3.1. When when placing a ticket order through one of the Msales sales, the Buyer accepts the Terms, as well as, where applicable, the special terms set forth in the Sales Medium and the Organizer’s terms and conditions as communicated by the Organizer.

IIt is recommended that thethe Buyer save or print the Terms when the online ordering process ..

3.3.2.WhenTickets (or optional goods)are purchased online, the order is confirmed by a confirmation email automatically sent by Brussels Expo to the Purchaser.

3.3.3. By making the payment, the Buyer confirms their intention to purchase the Tickets.

3.3.4.Unless otherwise specified at the time of ordering,payment for any ticket order is generally due immediately upon ordering and must be made atthat time.

Payment will be made in accordance with the Buyer’s choice of payment methods payment methods offered during the ordering process. The payment payment methods offered are payment by credit card or debit debit debit or by any other payment methodiavailable at the time of ordering. Credit card payments are subject to a validity check performed by the card issuer, who must authorize the use of the card.

3.3.5.Without prejudice to Section 3.1.4,the order will not be final until thebanking paymentcenters have confirmed their approvalandBrussels Expo has receivedpayment.

When thepayment is not authorized by the payment processor, Brussels Expo will issue Ttickets ordered automatically for sale. The Buyer may not bring any claim against Brussels Expo in such a case and if, following the resale, the Ttickets have been reallocated to a third party and are no longer available.

3.3.6.The Buyer is hereby informed that Brussels Expo does not intervene in any way in payment transactions, which are exclusively under the control of thepaymentservice provider. Brussels Expo cannot be held liable in the event of the payment service being unavailable or malfunctioning.

3.3.7.In accordance with Section 3.1.4, Brussels Expo reserves the right to cancel orders for Tickets where there is reasonable suspicion that they were placed fraudulently.

ARTICLE 4 : DELIVERY OF TICKETS

4.1 DELIVERY TERMS DELIVERY

4.1.1. Upon receipt of payment by Brussels Expo, the Buyer will receive an email confirming their purchase. The Buyer is therefore required to provide a valid email address when placing the order and to check for any emails from Brussels Expo that may have been blocked by spam filters.

 

Tickets (“ e-Ticket(s) )) can be sent in one of the following ways:

Instant delivery: The Buyer will receive their e-Tickets immediately via emailconfirmation email, either as an attachment or as a downloadable file;
Delayed delivery: The Buyer will receive their e-Tickets later via email, at a time determined by the Organizer and specified in the e-confirmation email. 

4.1.2.Each Ticket has a unique barcode or QR code that identifies and authenticates it.

4.1.3.The Buyer is responsible for keeping the Tickets safe and for usingthe Tickets in accordance with the provisions of Section 5 of the Terms and Conditions.

4.2 DEFECTS IN DELIVERY

4.2.1.If the Buyer does not receivea confirmation email or their Ticket(s), they must notify Brussels Expo as soon as possible byemail at the followingaddress: tickets@ticketlive.be.

4.2.2.If the barcode or QR code on the Ticket is illegible or difficult to read (provided this is not due to the Buyer having printed the Ticket incorrectly), the Buyer must notify Brussels Expo as soon as possible byemail at tickets@ticketlive.be. In such a case, and after Brussels Expo has verified the defect, Brussels Expo will issue a duplicate Ticket. No compensation or refund will be provided.

4.2.3.Brussels Expo assumes no liability if the contact information (last name, first name, address, email) provided by the Purchaser is incorrect and, as a result, the Purchaser’s Ticket cannot be issued or does not grant access to the event.


ARTICLE 5 : USE OF TICKETS

5.1. The Purchaser of the Ticket must comply with the law regarding the resale of event admission tickets (M.B., July 30, 2013, as amended by subsequent laws).The Tickets are reserved for private use and may not under any circumstances be transferred or resold for commercial purposes. In accordance with the aforementioned law, the habitual resale of Tickets is prohibited, as is the occasional resale at a price higher than the retail price. If the Ttickets were not purchased through an official sales channel, access to the event for holders of Ttickets may be denied.

5.2. The original purchaser who transfers the Tickets obtained from Brussels Expo undertakes to provide prior notice the Terms to the persons to whom they transfer the Tickets and guarantees theacceptance of the Terms by these individuals. The Tickets are always issued in the name of theAoriginal purchaser, even in the case of occasional resale (unless such resale takes place via Ticketswap).

5.3. The Ticket serwill scanned at the event entrance. Unless otherwise stated on the Ticket, at TTicket with a barcode or QR code entitles the holder to a single entry to the event. If the same barcode or the same QR code is presented multiple times, only the first ticket presented and scanned will grant access to the event. Holders of photocopies will therefore be denied access to the event.

5.4. The Ticket is valid only for the date and time of the event indicated on the TTicket. Any attempt to reuse or copy a TTicket will be considered fraud. Any misuse, falsification, or counterfeiting of the Ticket may result in legal action. Brussels Expo reserves the right to deny entry to the event to anyone who does not have a ticket obtained by the ordering process described in the Terms and Conditions. Proof of payment does not constitute a validvalid ticket for the event.

5.5. The Buyer may print the e-Ticket from the download link sent by Brussels Expo. In this case, the e-Ticket must be printed in color or black and white on white A4 paper. The print quality must be perfect, and all elements of the e-ticket, including the barcode or QR code, must be legible, otherwise access to the event will be denied.

The e-Te-ticket may also be presented by the Purchaser on their smartphone with a sufficiently bright screen.

5.6. When the Ticket or the is is registered to a specific person, a valid form of identification may may be requested from the Purchaser during access checks at the event. Brussels Expo shall in no event be liable if it has not performed this optional verification, for example in the event that the Ticket has been counterfeited.

5.7. The Ticket will not be replaced, refunded, or exchanged, particularly in the event of loss, theft or if it is not used on the day of the event.

5.8. If the Buyer arrives after the time indicated on the Ticket for the event, they will generally no longer be admitted to the event, unless the Event Organizerdecides to let latecomers in during any breaks. Due to the layout of certain venues or constraints related to the event, it may be impossible for the Organizer to allow latecomers to enter. In thiscases case, the Buyer’s will be forfeited, without any compensation for the Buyer. If the Organizer decides to admit latecomers, the Buyeragrees the assignment any other seats that may be available (which may be in other categories) and waives any recourse against Brussels Expo in this regard and the Organizer.    

5.9. The Buyer must keep the Ticket for the duration of their attendance at the event and must be able to present it upon request.

 

ARTICLE 6 : PLATFORM OPERATION, LIABILITY, ANDCANCELLATION


6.1. CONTENT AND OPERATION OFSALES CHANNELS

6.1.1.Brussels Expo assumes no liability for any consequences arising from access to or use of the ticketing platform. Furthermore, Brussels Expo makes no warranties, express or implied, regarding the error-free, virus-free, or bug-free operationof the ticketsales channels, or their uninterrupted availability .

Brussels Expo cannot be held liable for any direct or indirect damages resulting from a visit to or use ofthiss Resources forfor sale it makes available (particularly in the event of content loss resulting from uploading or downloading to thea Pticketing platform).

6.1.2.Brussels Expo makes reasonable efforts to provide information that is as up-to-date, accurate, and complete as possible, but cannot offer any warranty, express or implied, regarding the security, accuracy, or completeness of the information, whether regarding the goods or services available through the various sales channels it provides.

Brussels Expo cannot be held liable for acts and omissions, the goods and services offered, as well as the information provided on thes ssiteweb web of third(including the Organizer and the artist) dedicatedto specifically for the event, including those to which thehas Pticketing platform refers to or links to, whether regarding regarding the content oror operation of these sites websites. The content of websites of third-party that contain links to the Pticketing platform, as well as the links themselves, are beyond the control of Brussels Expo and falltherefore therefore fall under the exclusive responsibility of these third parties.

6.2. LIABILITY, CANCELLATION AND POSTPONEMENT OF THE EVENT

6.2.1. The Buyer is required to verify all communications relating the organization of the event. TheThe start and end times of the advertised event are subject to change. It is recommended the Buyer to check check, before theevent, of any changes that may affect the event. Brussels Expo will make reasonable efforts to notify the Buyer in writing of any changes to the event, to the extent possible.

6.2.2. Under no circumstances may the Buyer claim damages and damages or or any reimbursement from Brussels Expo due to a lack of quality of the event, the content of the event, a change in the content or the course of the event, or a delay in its conduct.

Similarly, Brussels Expo cannot be held liable in the event of discrepancies between the photos, videos, illustrations, or descriptions used in the presentation and/or promotion of the event as they appear on any promotional material for the event itself. Brussels Expo accepts no liability for the accuracy of the information provided on the Pticketing platform or on another sales channel and which has been provided to Brussels Expo by the event organizer or by third parties (artists, etc.).  

6.2.3. LWhen Brussels Expo acts as a ticket sales service provider for an Organizer (other than Brussels Expo), changes to the program, date, and/or venue, changes to the layout, availability, or seating arrangement, and any other change, cancellation, interruption, or postponement of the event decidedby by the Organizer of the event are the sole responsibility of this Organizer.

 

6.2.4. Unless the Organizer has provided its terms and conditions relating in particular tocancellation or or postponement ofTothe buyer, the following conditions apply in the event of cancellation or postponement of the event:  

in the event of cancellation : when an event is canceled and is not postponed or rescheduled, a refund of the purchase price of the Tickets may be offered to the Buyer, excluding certain fees (such as transaction fees or shipping costs). If an event was scheduled to take place over several days and one or more days are canceled (but not all days of the event), a partial refund corresponding to the canceled days may be offered to the Buyer ;

in the event of a postponement : unless otherwise specified for a particular event, when an event is postponed (or moved up), the purchased Ticket remains valid for the rescheduled event. These tickets will have the same value as the original tickets purchased by the Purchaser. If you are unable to attend the rescheduled event, themust must provide proof of his impediment within the specified timeframe in the rescheduling email. In this case, a refund of the purchase price of the Ticketsmay be offered, excluding certain fees (such as transaction fees or shipping costs). The Buyer will be informed in the rescheduling email of the specific timeframe within which they must respond if is unable to attend the postponed (or rescheduled) event. If the Buyer fails to communicate their decision within this timeframe, the reservation for the new event date will be confirmed and the Buyer will not be entitled to a refund.

Brussels Expo is not required to issue any refund to the Purchaser, unless it has been agreed between the Organizer and Brussels Expo that Brussels Expo will, in the name and on behalf of the Organizer, issue a refund for the Tickets or unless Brussels Expo acts in its capacity asOrganizer.

Unless Brussels Expo is acting in its capacity as Organizer, thethe Buyer expressly agrees to waive any and all claims against Brussels Expo arising from the cancellation or postponement of the event decided by the event Organizer.  

6.2.5. Tthe use of linings in a performance (for example, in a play or musical) and/or any changes to a headliner, band members, or team members and/or the lineup of any multi-(particularly for a festival) shall not give rise to an exchange or refund of the Ticket price.  

6.2.6. Unless expressly agreed by the Organizer of the event or Brussels Expo when acting in its capacity as Organizer, no order for Tickets may be modified or canceled by the Purchaser after the order has been confirmed, meaning that Tickets will neither be exchanged nor refunded.

6.2.7. In any event, the refund of the sale price of the Tickets will only be made to the original Purchaser of the initial transaction in accordance with the same method of paias the one used when placing the order (credit card or debit card). The Buyer transferring the Tickets agrees to inform the transferees of this provision.

6.2.8. Except in cases of fraud, fraud or gross negligence on the part of Brussels Expo or its employees or agents :

i. Brussels Expo’s liability is limited to foreseeable direct damage, which is equal the value ofthe Tickets, goods and/or the service orderedby by the Buyer from Brussels Expo ; and
ii. BRussels Expo cannot be held liable for loss of profits or savings, loss of revenue, loss of customers, loss of data, opportunities or any other indirect or unforeseeable damage at the time of sale of the Ttickets.

Brussels Expo shall not be liable for any hearing or vision impairment, or any other skin or physical conditions resulting from attendance at the event to which the Ttickets, unless Brussels Expo also acts as the event organizer and such impairments and other skin or physical conditions result from an act or omission on the part of Brussels Expo.

6.2.9. The Buyer and any persons accompanying him or her are requiredto to comply with the regulations applicable to the event and the venue (house rules, safety, evacuation, health measures, etc.). Theyagrees undertakesto to behaver like any prudent and diligent person during the event and to comply with any requests from security personnel.

The Purchaser agrees to comply with all preventive and security measures (such as bag searches) implemented by Brussels Expo or the Organizer and/or the relevant authorities in order to gain access to the event. Failure to comply with these measures may result in denial of access to the event, without any refund of the Tickets to the Purchaser (and any accompanying persons).

It is In particular, prohibited from bringing any dangerous objects, items that could be used as projectiles, or any pyrotechnic devices into the event.

The Purchaser or Ticket Holder, as well as any accompanying persons, attend the event at their own risk. Under no circumstances shall Brussels Expo be held liable for any damage, whether property damage or bodily injury, caused to third parties by the Purchaser or Ticket Holder or to themselves or their property. This is without prejudice to the provisions of Article 6.2.7.  

6.3. FORCE MAJEURE

Under no circumstances shall Brussels Expo be held liable for any failure to its contractual obligationsattributable due to unforeseeable circumstances or force majeure. The following are considered force majeure events, in particular, without this list being exhaustive:  fire, flood, earthquakes, thunderstorms, hurricanes, and any other natural disaster or exceptional weather conditions, diseases, pandemics or epidemics, seizure, decisions or sanctionssby authorities, embargo, strike, lockout, blockade, power outage, interruption of telephone and internet connections, terrorist activities, terror alerts, war, civil war, revolt, demonstration, revolution, strikes, machine breakdowns or accidents, or exceptional traffic accidents, supply difficulties, failure of suppliers or carriers or any other unforeseeable and beyond of the will or dor control of Brussels Expo and which makes the performance of obligations temporarily or permanently impossible. Such events release Brussels Expo from any liability and grant entitle it, as the case may be, either to reduce the obligations or to terminate the contract or to suspend its performance for the duration of the force majeure without being requiredtoto pay any compensation.

ARTICLE 7 : INTELLECTUAL PROPERTY RIGHTS

7.1.Tickets, their design, and their components (including names, trademarks, domain names, logos, graphic designs, photographs, videos, text, and other content and works) remain at all times the exclusive property of Brussels Expo or have been authorized for use by third parties, and therefore may not, in whole or in part, in any form, on any medium, or by any means whatsoever, reproduced, exploited, copied, imitated, or distributed without the prior written authorization of Brussels Expo, except for the purpose of printing in accordance with Article 5.5 of the Terms and Conditions.

All text, images, and photos featured on thea Pticketing platform are protected by copyright and may not be used for any purpose whatsoever without theprior written authorization from Brussels Expo.
Unless otherwise authorized in writing from the Organizer, any commercial use of the name or logo of the event or the artist is strictly prohibited and is subject to legal action.

7.2.Photography, filming, and recording of the performance or event , in any form whatsoever, are prohibited .

If Brussels Expo or the Organizer has indicated that the event would be filmed and/or photographed, the Purchaser (and the public) may appear incidentally in said recording. By accepting the Terms and Conditions and/or attending the event, the Purchaser and the persons accompanying them at the event agree that their image may be reproduced as part of this recording and used, in any form whatsoever (including for commercial purposes), by Brussels Expo or the Organizer. This right is granted worldwide and free of charge.

ARTICLE 8 : PROTECTION OF PERSONAL DATA (PRIVACY POLICY) AND COOKIES

8.1 PRIVACY PRIVACY POLICY

When ordering online Tickets by the Buyer, Brussels Expo collects, processes and stores personal data, which Brussels Expo endeavors to do in accordance with the Buyer’s rights, in accordance Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter “ GDPR ”) and applicable national laws applicable adopteds in accordance with thereof, including the Act of July 30, 2018, on the protection of natural persons with regard to the processing of personal data.

By “ personal data ", means the personal data provided when the purchase of Tickets or during the eventprocess such astitle, name, email, mailing address, phone number, language, date of birth or other information related to the event  (hereinafter Personal Data).

The Personal Data is processed in accordance with the Privacy Policy available here: https://www.brussels-expo.com/a-propos/politique-de-confidentialite.

When placing an order subject to the Terms and Conditions, the Buyer declares that they have read the Privacy Policy and acceptsits contents without reservation.

Please note that both Brussels Expo and the event organizer act as data controllers as defined in the Privacy Policy.

8.2. COOKIES

ARTICLE 9 : MISCELLANEOUS

9.1. The invalidity, unenforceability, or non-applicability of any provision of the Terms and Conditions under applicable laws or regulations shall not affect the validity of the other provisions of the Terms and Conditions, which shall remain in full legal force and shall remain in effect. The provision that is wholly or partially void, voidable, or unenforceable shall be deemed unwritten and shall be replaced or considered to have been replaced by the parties with a similar provision that complies with the law and that fulfills, to the extent possible, the same function.

9.2. The fact that Brussels Expo or the Buyer does not assert a right or does not rely on a possible breach of any of the obligations incumbent upon the other party shall not be construed as a waiver of the right or obligation in question.

9.3. The Terms and Conditions and the relationship between Brussels Expo and the Buyer are governedsolely by Belgian law.

9.4. Any dispute relating to the formation, interpretation, or performance of the Terms or arising from the relationship between Brussels Expo and the Purchaser shall be subject to the exclusive jurisdiction ofthe courts of Brussels.
